Old Dominion Freight Line Sued for Disability Discrimination

The U.S. Equal Employment Opportunity Commission filed suit against Old Dominion Freight Line, alleging the carrier violated federal law by discriminating against at least one truck driver because of self-reported alcohol abuse.

It shouldn't matter that he completed the program or not. He could "relapse" at anytime. I would imagine that reinstating him to a driving position knowing that he had a drinking problem would jack up the carriers insurance rates. If he had an accident while driving for the company while under the influence that's even worse for them. It sounds like they made a shrewd business decision.

The fact that he came forward of his own accord, that OD has acted in the same manner before, and that he is suing for " monetary relief in the form of reinstatement to a driving position, back pay and compensatory and punitive damages, compensation for lost benefits for two drivers, and an injunction against future discrimination." makes me wonder if it isn't just an attempt to milk the legal system.

Neither ADA, or EEOC rules or regulations preempt rules set forth by the FMCSA, which is the regulatory body that the industry works under. Even though the individual in question had not been convicted of a DUI offense, Old Dominion could not with good conscience act otherwise. On the other hand it sounds like the fellow just didn't want to work but still wanted to be paid.

What a crock of :icon_bs: IVE GOT A VERY MILD OF CEREBRAL PALSY in my left side, You can see my handicap & im working & I DONT COMPLAIN EVEN WHEN IM IN EXTREME PAIN @ WORK, but my boss (guy used to sell my family our truck tires when we was in business till almost 6yrs ago) knows when im in extreme pain & let me take my time . now you can have a drinking or drug problem & you can get a DISABILITY CHECK? GIVE ME A DAMN BREAK . Sheesh

well thier complaint was after SUCCESSFULLY,finishing,boozer program,,the company wasnt going to put him behind the wheel.bob

I read the article in O.D mag and the driver did not take the companies program that is in a rehab facility, he joined AA to save his insurance costs before reimbersment. Most everybody I've seen in AA drinks as much or more than before they joined. Paul
