Democratic candidates Hillary Clinton and Bernie Sanders clashed over support for the president at a PBS NewsHour televised debate.

Clinton sought to cast herself as the protector of Barack Obama's legacy, sharply attacking Mr Sanders for criticising the president.

"The kind of criticism I hear from Senator Sanders, I expect from Republicans," Clinton said.

"Madame secretary, that is a low blow,' Sanders replied. 'I have worked with President Obama for the last 7 years. One of us ran against Barack Obama, I was not that candidate."

At the debate, Clinton repeatedly emphasised her ties to Obama, who is extremely popular among minority voters.

Sanders took pains to tailor to his message of economic fairness to address disparities in black communities.

Clinton also stressed her pragmatism, questioning Sanders' pledges to provide universal healthcare and free higher education.

"We have a special obligation to make clear what we stand for which is why we can't make promises we can't keep," Clinton said.

Clinton Charity Aided Clinton Friends

A $2 million commitment arranged by the nonprofit Clinton Global Initiative in 2010 went to a for-profit company part-owned by friends of the Clintons

The Clinton Global Initiative, which arranges donations to help solve the world’s problems, set up a financial commitment that benefited a for-profit company part-owned by people with ties to the Clintons, including a current and a former Democratic official and a close friend of former President Bill Clinton.

The $2 million commitment was placed on the agenda for a September 2010 conference of the Clinton Global Initiative at Mr. Clinton’s urging, according to a document from the period and people familiar with the matter.

Mr. Clinton also personally endorsed the company, Energy Pioneer Solutions Inc., to then-Energy Secretary Steven Chu for a federal grant that year, said people with knowledge of the endorsement.

The company, whose business plan was to insulate people’s homes and let them pay via their utility bills, received an $812,000 Energy Department grant. Mr. Chu, now a professor at Stanford University, said he didn’t remember the conversation.

The Clinton Global Initiative is a program of the Bill, Hillary and Chelsea Clinton Foundation. The foundation has been a focus of criticism this political season over donations received from governments and corporations that had business before Mrs. Clinton when she was secretary of state and that could be affected by decisions she would make as president. The foundation has said it “has strong donor integrity and transparency practices.”

The Clinton Global Initiative’s help for a for-profit company part-owned by Clinton friends poses a different issue. Under federal law, tax-exempt charitable organizations aren’t supposed to act in anyone’s private interest but instead in the public interest, on broad issues such as education or poverty.

“The organization must not be organized or operated for the benefit of private interests,” the Internal Revenue Service says on its website.

Energy Pioneer Solutions was founded in 2009 by Scott Kleeb, a Democrat who twice ran for Congress from Nebraska. An internal document from that year showed it as owned 29% by Mr. Kleeb; 29% by Jane Eckert, the owner of an art gallery in Pine Plains, N.Y.; and 29% by Julie Tauber McMahon of Chappaqua, N.Y., a close friend of Mr. Clinton, who also lives in Chappaqua.

Owning 5% each were Democratic National Committee treasurer Andrew Tobias and Mark Weiner, a supplier to political campaigns and former Rhode Island Democratic chairman, both longtime friends of the Clintons.

The Clinton Global Initiative holds an annual conference at which it announces monetary commitments from corporations, individuals or nonprofit organizations to address global challenges—commitments on which it has acted in a matchmaking role. Typically, the commitments go to charities and nongovernmental organizations. The commitment to Energy Pioneer Solutions was atypical because it originated from a private individual who was making a personal financial investment in a for-profit company.

Asked about the commitment, foundation officials said, “President Clinton has forged an amazing universe of relationships and friendships throughout his life that endure to this day, and many of those individuals and friends are involved in CGI Commitments because they share a passion for making a positive impact in the world. As opposed to a conflict of interest, they share a common interest.”

A spokesman for Mr. Clinton, Angel Urena, said, “President Clinton counts many CGI participants as friends.” Mrs. Clinton’s campaign didn’t respond to a request for comment.

A Clinton Foundation spokesman, Craig Minassian, called the commitment an instance of “mission-driven investing…in and by for-profit companies,” which he said “is a common practice in the broader philanthropic space, as well as among CGI commitments.” Of thousands of CGI commitments, Mr. Minassian cited three other examples of what he described as mission-driven investing involving a private party and a for-profit company such as Energy Pioneer Solutions.

Ms. Eckert, one of those identified as a 29% owner of Energy Pioneer Solutions in 2009, didn’t respond to requests for comment.

Ms. McMahon, listed as another co-owner, said in an interview she didn’t know how the commitment to the company came to be made as she wasn’t involved. Ms. McMahon, 56 years old, described Mr. Clinton as “a family friend.”

Mr. Kleeb, who is the company’s chief executive as well as founder, said Ms. McMahon recruited Mr. Weiner as an investor. Mr. Weiner has a company, Financial Innovations Inc., that makes campaign souvenir items such as coffee mugs and pens. Mrs. Clinton’s current and 2008 presidential runs have paid Mr. Weiner’s firm about $4.2 million, federal reports show.

Mr. Weiner was among the first state Democratic officials to endorse Mr. Clinton for the presidency some 25 years ago. He has been a major donor to the Clinton Foundation and also to the campaign of Virginia Gov. Terry McAuliffe, another Clinton friend, foundation and Virginia records show. Mr. Weiner declined to be interviewed.

The other 5% investor, Mr. Tobias, has been the Democratic National Committee treasurer since 1999. He said he spent $450,000 for equity in Energy Pioneer Solutions and lent it $650,000.

“With my modest initial investment, I wound up owning a small percentage of the company,” Mr. Tobias said in an email. “It grew, because ultimately, between loans and equity investments, I’ve wound up putting a little more than $1 million into this effort.”

Mr. Tobias, a best-selling personal-finance writer and long-standing Clinton Global Initiative member, said he invested “because I would love to see the world more energy-efficient and hoped to make some money doing that.” Records of the Clinton Foundation show he has given it between $250,000 and $500,000, the same donation level shown for Mr. Weiner.

The company’s Mr. Kleeb said he knew the DNC treasurer from his own runs for office and invited him to invest. Mr. Kleeb won Democratic nominations in Nebraska for the U.S. House in 2006 and the Senate in 2008, but lost. His wife, Jane Kleeb, led opposition to the Keystone XL Pipeline and now heads a group called Bold Alliance opposing large fossil-fuel projects.

The Clinton Global Initiative, at a Sept. 23, 2010, gathering in New York, announced a $2 million commitment to Energy Pioneer Solutions from Kim Samuel, a Canadian academic, philanthropist and a director and owner of the Samuel Group of Companies, which includes steel businesses. She appeared on stage.

A spokesman for Ms. Samuel, a longtime member of the Clinton Global Initiative, said she ultimately chose not to give the full $2 million.

This is a “personal financial matter and a personal investment,” said her spokesman, Alan Peck. “Following the initial September 2010 announcement and subsequent due diligence, the actual investment was $500,000 made by Ms. Samuel to Energy Pioneer Solutions on July 25, 2011.”

Mr. Tobias, the Democrats’ treasurer, said in an email a day after a Journal interview that he, too, contributed to the commitment. The 2010 announcement of it cited only Ms. Samuel.

Mr. Kleeb said the commitment announced was achieved, and he raised $2 million. He didn’t specify where the money came from.

The commitment was a late addition to the agenda for the September 2010 conference, internal Clinton Foundation documents reviewed by the Journal show.

According to one document, about two weeks before the conference, Ms. Samuel contacted an official in the Clinton Foundation’s commitments office and said Mr. Clinton wanted to feature her commitment to Energy Pioneer Solutions at that month’s gathering. Ms. Samuel’s spokesman didn’t respond to a question about that.

One of Mr. Clinton’s top advisers at the time, Doug Band, tried to prevent the commitment from being added to the agenda as an onstage event in the weeks prior to the conference, according to a document reviewed by the Journal.

The commitment was entered into a database on the Clinton Global Initiative website. A few months later, it was removed.

The reason was to avoid calling attention to Mr. Clinton’s friendship with one company co-owner, Ms. McMahon, and to protect the integrity of Mr. Clinton and the Clinton Global Initiative, according to people familiar with the matter.

The Clinton Foundation spokesman said the information was withheld at the request of Ms. Samuel, the announced provider of the commitment. Her spokesman didn’t respond to a question on that.

After the Journal asked about the absence from the database, the Clinton Foundation said it was making a policy change and would publish all previously unpublished commitments and all future ones.

At the U.S. Energy Department, which had a grant program to encourage innovative approaches to weatherizing low-income people’s homes, giving a grant to a for-profit company was rare but permitted, said T.J. Hansell, a former contractor to the agency who worked on the program. An Energy Department spokeswoman declined to comment.

An Energy Department news release in 2010 announcing a grant to Energy Pioneer Solutions called it “a women-owned small business,” repeating language in the company’s application, which the Journal obtained under the Freedom of Information Act. Mr. Kleeb, the company’s founder and 29% owner, didn’t respond to a question on why it described itself as women-owned.

On occasion, Mr. Clinton has trumpeted the company’s work. Speaking in 2011 to an Omaha-based syndicated radio show called The Todd-N-Tyler Radio Empire, Mr. Clinton said: “There’s a group there called Pioneer Energy Solutions that retrofits housing—they’re in and out in a day…Eight hours and they’re out of there.”

Mr. Clinton also cited the operation, without naming the company, in his 2011 book “Back to Work.”

Mr. Tobias, the Democratic treasurer, said he discussed Energy Pioneer Solutions frequently with Mr. Clinton. “I wasn’t surprised that President Clinton was psyched about the potential for EPS and making America’s housing stock more efficient, cutting CO2 emissions and lowering consumers’ energy bills,” Mr. Tobias said.

Energy Pioneer Solutions has struggled to operate profitably. It lost more than $300,000 in 2010 and another $300,000 in the first half of 2011, said records submitted for an Energy Department audit. Mr. Kleeb noted that losses are common at startups.

The audit found deficiencies in how the company accounted for expenses paid with federal grant money, Energy Department records show. The company addressed the deficiencies, and a revised cost proposal was approved in 2011, said an Energy Department spokeswoman, Joshunda Sanders.

Recently, Mr. Kleeb laid off most of his staff, closed his offices, sold a fleet of trucks and changed his business strategy, promising to launch a national effort instead. “We are right now gearing up to start under this new model,” he said.

Asked if Energy Pioneer Solutions has ever broken even, Mr. Kleeb said, “We’re at that stage…We are expanding and doing well. We have partnerships, and it’s good.”

BOSTON (AP) — Massachusetts Sen. John Kerry is docking his family’s new $7 million yacht in neighboring Rhode Island, allowing him to avoid paying roughly $500,000 in taxes to the cash-strapped Bay State.

If the “Isabel” were kept at the 2004 Democratic presidential nominee’s summer vacation home on Nantucket, or in Boston Harbor near his city residence, he would be liable for $437,500 in one-time sales tax. He would also have to pay $70,000 in annual excise taxes.

Rhode Island repealed those taxes in 1993. That has made the state something of a nautical tax haven.

 Kerry's $7 million luxury yacht that was built in New Zealand, even though one of the main industries in Kerry’s home is shipbuilding, an industry that has, by the way, been suffering of late and could have used the work – building a boat that size, according to some estimates, would employ the equivalent of an entire small town for 12 months.

Kerry called Rubio's boat a frivolous purchase, it's a 24 foot, twin Mercury outboard powered  open fishing boat.  You can rent Kerry's from him for a mere $45,000.00 per day plus fuel, food, drink and a 5 star Chef.

UAW Leader Suggests Union Will Back Clinton for U.S. President

United Auto Workers President Dennis Williams said his union won’t endorse Donald Trump for U.S. president, all but assuring support for Hillary Clinton as she closes in on the Democratic nomination.

Williams said the UAW will wait until the conclusion of the Democratic primary before endorsing a candidate. Clinton has 2,293 delegates to 1,533 for rival Bernie Sanders. Clinton needs only 90 of the remaining 939 unallocated delegates to lock up the nomination.

The UAW could help Clinton by cajoling its 1 million workers and retirees to vote and campaign for her in the industrial Midwest, where she struggled against Sanders in the primary elections. The union’s big issues are trade and income equality, which Sanders successfully used to win votes in current and former auto-producing states Michigan, Indiana and Wisconsin.

While Williams stopped short of making an endorsement on Thursday, he said the union’s executive board likes Clinton and Sanders and won’t support Trump, the presumptive Republican nominee.

Williams also exonerated her from blame for the trade agreements enacted by her husband, former President Bill Clinton. He signed the North American Free Trade Agreement (NAFTA) which has been a sore point with the union ever since.

“He made a bad mistake with NAFTA,” said Williams. “It has been very harmful to us. I don’t blame Hillary. That was Bill.”

Blue-Collar Battle

While Trump’s criticism of automakers investing in Mexico resonates with autoworkers, his suggestion that companies shift manufacturing to lower-wage states undermines the union’s efforts to preserve compensation for members in states like Michigan and Ohio.

“He said he would close plants here and move jobs to lower-wage states,” Williams said. “How does that help the middle class?”

The UAW has lost political influence as its membership has declined, but it still can help a candidate. Clinton, the former secretary of state, has sought to woo middle-class voters by taking on corporations like Milwaukee-based auto parts supplier Johnson Controls Inc. over a merger that would shift its tax base to Ireland. But Sanders appealed to many blue-collar voters by highlighting her support from Wall Street banks and her husband’s approval of free-trade deals.

Even Trump has appeal to some workers. Williams said 28 percent of UAW members said in an internal union survey that they supported the real estate mogul in his presidential bid. He believes that support is declining since Trump made his comments to the Detroit News about moving jobs to lower-wage states.

Benefit Balance

The union has been struggling to find a balance between getting higher wages for its members and keeping workers competitive with factories overseas.

Labor agreements ratified last year with General Motors Co., Ford Motor Co. and FCA US LLC, the North American unit of Fiat Chrysler Automobiles NV, gave raises to entry-level workers, who start at lower pay and with less-valuable benefits. While allowing new workers to reach to the top pay scale, the contracts didn’t prohibit automakers from investing in places like Mexico, particularly to make smaller, less-expensive cars, and importing models from China.

That stunts growth of union membership at U.S. auto plants and leaves the UAW more reliant on sales of pickups and sport utility vehicles. The UAW, contending with a recent right-to-work law in Michigan, is now focused on organizing workers in other industries and at U.S. plants owned by foreign automakers like Volkswagen AG to get more members, Williams said.

FCA said it will stop making its Dodge Dart compact and Chrysler 200 mid-sized cars and focus its U.S. production on Jeep SUVs and other larger vehicles. Ford has said it will stop building its Focus compact in Michigan; that work will go to Mexico, said a person familiar with Ford’s plans. Autoworkers in 2013 earned $8.24 an hour on average in Mexico, compared with $37.62 in the U.S., according to the Center for Automotive Research.


 

Hillary Clinton's email server violated State Department rules, audit finds

Efforts by the former secretary of state to move on from her email controversy hit a major setback as investigation finds disregard for department guidelines

Hillary Clinton’s efforts to move on from a damaging email controversy suffered their biggest setback yet on Wednesday with the release of an internal report finding she broke multiple government rules by using a private server rather than more secure official communication systems.

The 78-page investigation by the inspector general of the State Department singled out several previously unknown breaches by Clinton while she was secretary of state, including the use of mobile devices to conduct official business without checking whether they posed a security risk.

Although the report is potentially less damaging than a separate investigation by the FBI into whether she broke federal laws, it poses a significant challenge to the Clinton campaign, which has recently slipped behind Donald Trump in opinion polling.

Trump has stepped up attacks on Clinton’s trustworthiness in recent days and is likely to seize on the report as Democrats wait nervously for the FBI decision on whether to bring charges against Clinton or any of her advisers.

House speaker Paul Ryan said: “No public official is above the law. Secretary Clinton’s actions were at best negligent and at worst harmful to our national security. The State Department should work to ensure that all employees strictly comply with the law, and follow the IG’s recommendations to strengthen its record-keeping system.” [Note: the protection of classified U.S. government intelligence is rebadged with the low-key term “record-keeping”]

The Clinton campaign put a brave face on the inspector general’s report on Wednesday, pointing to sections that dealt with similar lapses in email security by previous office holders.

A spokesman for Clinton said the report showed that her email practices were “consistent” with those of past secretaries and senior officials.

A Clinton spokesman, Brian Fallon, said that the report showed problems with the State Department’s electronic record-keeping systems “were longstanding” and emphasized that her use of a private email server “was known to officials within the department during her tenure”.

Fallon acknowledged that “steps ought to have been taken” to better maintain official records.

However, the full report, a copy of which was obtained by the Associated Press (AP), cites “longstanding, systemic weaknesses” related to the agency’s communications. These started before Clinton’s appointment as secretary of state, but her failures were singled out as more serious and were said to disregard various State Department guidelines for avoiding cybersecurity risks.

The report also found that state department staff who raised the issue of Clinton’s email practices were effectively silenced. Two information resources managers went to their head of department in late 2010, it found. “In one meeting, one staff member raised concerns that information sent and received on Secretary Clinton’s account could contain federal records that needed to be preserved in order to satisfy federal record keeping requirements,” the report said.

But the staff member later recalled that the director said Clinton’s personal system had already been reviewed and approved by legal staff “and that the matter was not to be discussed any further”, the reported continued. Yet “as previously noted, OIG found no evidence that staff in the Office of the Legal Adviser reviewed or approved Secretary Clinton’s personal system.”

The other staff member who raised the issue said the director stated that the department’s mission is to “support the secretary and instructed the staff never to speak of the Secretary’s personal email system again”.

Despite guidelines to the contrary, Clinton used mobile devices to conduct official business on her personal email account and private server. She never sought approval from senior information officers, who would have refused the request because of security risks, the audit said.

“By Secretary Clinton’s tenure, the department’s guidance was considerably more detailed and more sophisticated,” it concluded. “Secretary Clinton’s cybersecurity practices accordingly must be evaluated in light of these more comprehensive directives.”

Clinton’s private email server appears to have been a target for hackers. The IG report found that on 9 January 2011, a technical adviser retained by former president Bill Clinton said he had shut down the server because he thought there was “someone was trying to hack us and while they [allegedly] did not get in I didn’t [sic] want to let them have the chance to”. There was another suspected attack later the same day. On 10 January, Clinton’s aide Huma Abedin told officials not to send her “anything sensitive” and said she could “explain more in person”.

The IG report states that on 13 May 2011, “two of Secretary Clinton’s immediate staff discussed via email the Secretary’s concern that someone was ‘hacking into her email’ after she received an email with a suspicious link”. It added: “However, OIG found no evidence that the Secretary or her staff reported these incidents to computer security personnel or anyone else within the Department.”

Asked about the hacking claims on Wednesday, a state department official, who did not wish to be named [why did our employee refuse to identify themselves?], said: “There are no findings about the security of secretary Clinton’s email system. The hacking email that is referenced includes language to the effect that the hack was not successful. That’s just from the email that it cited. But beyond that there’s no finding one way or the other about the security.”

The official also told reporters: “I think it’s clear from the report that the Department could have done a better job preserving emails and records of secretaries of state and their senior staff going back several administrations. And we also acknowledge the report’s finding that compliance with email and records management guidance has been inconsistent across several administrations.”

Asked for a straight answer as to whether Clinton did anything wrong, the official replied: “I think the IG report speaks for itself in that it found that leaving the Department with her emails, Secretary Clinton didn’t act in compliance with all the records policies in place. However, it also finds – and NARA has found – that she mitigated those problems and the Department has mitigated those problems.

“With respect to whether secretary Clinton was allowed to use a personal email, the IG report finds that she did not seek approval and the Department did not provide it. She has said that she wouldn’t make the same decision again, and the IG report notes that senior Department officials say that they wouldn’t have recommended it had she asked.”

Clinton has been dogged by questions about her email practices for more than a year, since the AP revealed that the clintonemail.com server was in the basement of her New York home while she served as the nation’s top diplomat from 2009-2013.

Though accepting it “highlighted challenges [it] and others are facing” the State Department itself sought to downplay the independent report [go figure] by its inspector general at a briefing in Washington.

“The policies regarding use of email have only really been clarified over the past several years. Many agencies are struggling with it,” spokesman Mark Toner told reporters at a daily press briefing.

“We do now have policies that would make it hard to set up alternative email. Clinton said she would not have made same choice again.”

He rejected suggestions, however, that the department was trying to “spin” the report, which will be officially published on Thursday.

“There’s not any effort to spin this. There’s not any effort to hide or obfuscate,” said Toner. “We acknowledge that we need to do a better job with our record keeping.”
