"33,000 Americans killed with guns and 2 out of 3 were suicides"

Couple other things that were interesting his tangent on slavery and the Muslims being prevented for worshiping in many places in the U.S.

Things you should know of his actions.

1. The orders stop short of requiring universal background checksAccording to Politico, "While Obama cannot unilaterally require universal background checks, top administration officials predicted the new guidelines would sweep in all sellers."

2. House Speaker Paul Ryan said Obama is subverting the constitution — "While we don't yet know the details of the plan, the president is at minimum subverting the legislative branch, and potentially overturning its will," he said in a statement, the Washington Examiner reported. "His proposals to restrict gun rights were debated by the United States Senate, and they were rejected. No president should be able to reverse legislative failure by executive fiat, not even incrementally. The American people deserve a president who will respect their constitutional right — all of them. This is a dangerous level of executive overreach, and the country will not stand for it."

3. Ted Cruz responded by raffling off a shotgun — On Sunday, the senator from Texas set up a webpage offering his supporters the change to win a shotgun engraved with his presidential campaign logo, MarketWatch reported. Cruz also said he would undo Obama's executive orders and strengthen Second Amendment rights as president.

4. Donald Trump would "unsign" the orders as president — The GOP frontrunner told a packed rally in Biloxi, Mississippi, on Sunday that he is opposed to Obama's gun control plans. "There's an assault on the Second Amendment. You know Obama's going to do an executive order and really knock the hell out of it," Trump said, according to CNN. "You know, the system's supposed to be you get the Democrats, you get the Republicans, and you make deals. He can't do that. He can't do that. So he's going to sign another executive order having to do with the Second Amendment, having to do with guns. I will veto. I will unsign that so fast."

5. Marco Rubio vowed to undo Obama's orders on "day one" — Speaking Sunday evening in New Hampshire, the second primary state and a thoroughly pro-gun state, Rubio said Obama "has waged war on the Constitution" by issuing executive orders against the Second Amendment, Time magazine reported. "Don’t worry," he continued, "on my first day in office, behind that desk, don’t worry, those orders are gone."

6. The orders will reduce background check exemptions for many hobbyists — Currently, gun sales by hobbyists and collectors do not require background checks, but sales by professional gun dealers "engaged in the business" of dealing guns do require background checks (and also require the seller to obtain a federal license). The new executive orders will seek to limit hobbyist exemptions by clarifying an existing law so that sellers who sell firearms at gun shows and online can be classified as professional gun dealers, USA Today reported. This will close, what some call the "gun show loophole."

7. Hobbyist exemptions are not based on sales location or numbers — After meeting with Obama on Monday, Attorney General Loretta Lynch said, "Let me be clear: It’s not where you are located but what you are doing that determines whether you are engaged in the business of dealing in firearms." Likewise, the order does not set a numerical threshold on what differentiates hobby sales from professional sales. Lynch did note, however, that as few as two gun sales have in the past triggered background check requirements, as determined by the courts.

8. Exemptions will be determined holistically — White House Senior Adviser Valerie Jarrett said the ATF will take into account all the "facts and circumstances" of the gun seller when determining exemption status. Things like business cards, ability to take credit-card payments, profit margins, and original packaging are all part of the equation.

9. Obama requested more money for mental healthcare — The president requested $500 million be added to the federal budget in order to improve access to mental healthcare.

10. The FBI's background check system will get more staff — One of Obama's executive orders requires the hiring of more staff, 230 examiners, so that the government is equipped for "processing background checks 24 hours a day, 7 days a week instead of 9 to 5 , 5 days a week" Fox News reported. This is a roughly 50-percent staff increase.

11. The orders will NOT ban large capacity magazines — Ahead of the announcement, the Obama administration considered several measures that it ultimately decided it didn't have the power to do. One of those things was banning large capacity magazines for firearms, USA Today reported.

12. The orders will NOT ban people using the terrorist "no fly" list — After the San Bernardino terrorist attack, many called for banning anyone on the federal "no fly" list from obtaining firearms. Many said this was a terrible idea, as many prominent people and representatives who are clearly not involved in terrorist activity have appeared on the list in the past.

13. Obama also issued a presidential memorandum on "smart guns" — According to USA Today, "Obama directed the departments of Defense, Justice, and Homeland Security to study 'smart gun' technology to prevent accidental gunshots and allow better tracking of lost and stolen guns — with using the federal government's purchasing power to encourage gun makers to market safer firearms."

14. The orders would not have stopped recent mass shootings — Obama's executive orders would not have stopped the San Bernardino shooters, nor the Charleston church shooting, as perpetrators in neither case bought their guns under the hobbyist exemption. In fact, after the terrorist massacre in San Bernardino, The Associated Press reported, "The deadly shooting in San Bernardino happened in a state with some of the nation's toughest gun laws: California bars assault weapons, blocks the sale of large-capacity magazines, and requires universal background checks for all gun purchases."

15. The Supreme Court could stall and strike down Obama's orders — After the president tried to unilaterally overhaul the nation's immigration system via executive order, the Supreme Court issued an injunction, and the legality of the orders is now under review, Politico reported. Like the immigration orders, Obama's gun control measures could also come under judicial review. But since his staff worked with the DOJ and Constitutional Lawyers to form the Executive Order, it is highly unlikely to be challenged.

Republican presidential candidate Jeb Bush apologized Tuesday night for conflating his gun rights record by suggesting that he received an award from the National Rifle Association that doesn't exist.

The Bush campaign admitted on Monday that the former Florida governor was "mistaken and conflated multiple events unintentionally" when discussing an award he said he received from the NRA.

On several occasions in the past year, Bush has said he received the group's Statesman of the Year award and was handed a rifle by former NRA president Charlton Heston at the group's annual convention.

But the NRA doesn’t give out a statesman award, and Bush didn’t receive a rifle from Heston. Instead, he was given a rifle for being the keynote speaker at the NRA’s 2003 annual convention in Orlando.

Asked by reporters on Tuesday why he made the mistake, Bush said: "I don’t know, I thought.......I just read it."

I don't know how he gets away with the bs he pulls all the time. I do know I'm sick of hearing that dink threaten to get his way all the time with his pen and a telephone. Fundamentally it is so wrong for a president to go against the will of the people i.e. congress, senate and sign HIS own policies that the people don't necassarily want or at least want the option of saying yes to instead of told so into effect. I'm not a super smart guy but I do know people like obummers and other crappy politicians are why our second amendment is so very important. They can be brought in under HIS orders (up to 100,000) if they are classified as refuges by the Syrian Government or the UN. Both his buddies.

Also when the Republicans (who lied to us) passed his budget. It include funding for Obamacare and the Syrian Refuges. Both of which they said they would not approve funding for. They also included funding for the expanded NSA monitoring, funding for the at the time the unknown executive gun regulations and approval of Obama's Trans Pacific Trade Pact, which aside from subsidizing imported products from that area also eliminated the regulations that mandated the County of Origin and County of Manufacture be on the goods. So you can no longer attempt to Buy American.

As for the weapons executive order, it stays in "temporary effect" until Congress passes a permanent law to replace it... so it is forever.

He has created an Imperial Presidency, with his constant transferring power to the Executive Branch for the Legislative and Judicial Branches for "Streamlining government." Look at the powers the Executive Branch now has, there are no longer the checks and balances as before only the dominant Executive and sub servant Legislative and Judicial branches.

Agency tasked with enforcing Obama's gun control measures has been gutted

The beleaguered federal agency charged with bringing to life much of Barack Obama’s new roster of gun controls faces an uphill task to deliver meaningful change.

At the heart of the president’s executive action was a proposal to reinforce the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) with 200 new agents and investigators.

Though badly needed, the extra staff would be just enough to keep pace with the number of veteran agents who are eligible or almost eligible for retirement in the coming years, according to attrition estimates from a 2014 government report. And the personnel concerns are just one of the longstanding challenges the agency faces.

For decades, restraints, inadequate funding, impotent leadership and a lack of political constituency have stymied the agency from carrying out its core mission. Two years ago, a review by the Government Accountability Office found the agency lacked the resources needed to adequately track the outcomes of thousands of investigations involving improperly purchased firearms despite such cases being a “top priority”.

The same report identified serious personnel concerns, noting that ATF’s staffing was at its lowest level in nearly a decade, the result of a four-year hiring freeze and stagnant funding that “did not keep pace with the cost of employee salaries and benefits”.

ATF currently has 624 industry operations investigators in the field, who are tasked with conducting compliance inspections of more than 140,000 federally licensed firearms dealers in the US, the agency said. In broadening the definition of who should be classified as a gun dealer, Obama’s plan would likely add many thousands more to that total.

Now the agency is projected to lose a number of veteran agents who are near or already eligible for retirement.

“ATF is facing a reduction in its number of special agents, who according to management officials, are critical to carrying out its mission of reducing violent crime,’’ the report stated.

More than a quarter of ATF’s special agents qualified for retirement in 2013 and an additional 20% will become eligible through 2018, the report found.

The president asked Congress to fund 200 more agents and investigators to cope with the extra work, but the staffing figures make clear that even if Congress were to agree, the chances are that the workforce will stand still at best.

On Monday, the US attorney general, Loretta Lynch, told reporters that providing ATF with the additional resources is crucial piece of the plan. “We hope that Congress will see the wisdom of supporting this,” she said.

But that already seems unlikely. Republican lawmakers and presidential candidates were quick to condemn the president’s executive actions.

House speaker Paul Ryan accused the president of trampling on the second amendment. “No matter what President Obama says, his word does not trump the second amendment,” Ryan said in a statement, adding that the measures would be challenged in court.

Presidential candidate Marco Rubio pledged to repeal the plan if elected. “On my first day, it’s gone,” he said.

Hamstrung by the industry it’s supposed to regulate

The ATF is charged with regulating America’s multibillion-dollar gun industry. But many say it is the industry that dominates the agency.

“If you can strangle the chief agency charged with carrying out gun laws, it’s the equivalent of not having those laws in place,” said Robert Spitzer, author of The Politics of Gun Control and a political science professor at the State University of New York. “It’s a backdoor way to reduce gun regulations.”

Critics of the ATF, in particular the nation’s largest gun organization, the National Rifle Association, have successfully lobbied for laws and regulations that have effectively “crippled” the agency, Spitzer said.

Spitzer pointed to the series of “riders” attached to annual appropriations legislation at the behest of the gun lobby, he said, that have effectively hobbled the agency from completing even core functions of its mission.

One rider, for example, restricts the ATF from consolidating and computerizing its data in a modern manner. Another imposes prohibitions on its ability to regulate and oversee firearms dealers.

“ATF is the ‘whipping boy’ of the gun community,” Spitzer said. “And that’s how it’s been for decades.”

The ATF has long drawn the ire of conservative lawmakers and the gun lobby. Wayne LaPierre, the executive vice-president of the NRA, once referred to ATF agents as “jack-booted thugs” and compared them to Nazis, prompting former US president George HW Bush, a lifetime member, to resign from the organization in outrage.

In 1980, Ronald Reagan pledged during his first presidential campaign to abolish ATF. More than 35 years later, such calls are still circulating. Last year, Representative Jim Sensenbrenner of Wisconsin called the agency an “affront to the second amendment” when he reintroduced legislation that would abolish the ATF and transfer its core functions to other agencies.

There is now fresh concern that some conservative members of Congress would retaliate against Obama’s actions by trying to strip funding from the bureau.

“In the past, at times, when Congress didn’t like something that was proposed in gun legislation or regulation, they actually took money from the bureau’s budget and really hurt them more than anything else,” said Joseph Vince, a former ATF special agent and a partner at the Maryland-based consulting firm Crime Gun Solutions. “That’s a possibility and that could occur.”

Comparisons have been drawn between the ATF and family-planning organization Planned Parenthood, which has periodically had its federal funding threatened by conservative members of Congress amid controversy.

The agency’s reputation was further imperiled after the botched gun operation, known as “Fast and Furious”, when ATF agents lost track of nearly 2,000 guns, two of which were recovered at the scene of a murdered US border patrol agent.

But many of Obama’s measures outlined in an emotional speech on Tuesday, including his proposal to hire 200 ATF agents and investigators, will require funding increases that the Republican-led Congress is almost certain to deny.

“Whenever the ATF tries to move the ball forward and better enforce the laws and regulate the industry, you often see a response from some members of Congress to try to prevent them from doing so,” said Chelsea Parsons, vice-president for guns and crime policy at the Center for American Progress (CAP), a left-leaning thinktank in Washington.

Yet Parsons said the president’s endorsement of the agency and its mission sends a clear message.

“This is an agency that has historically been bruised and battered in Congress, and has had to fight and scrape for every resource that it gets,” Parsons said. “Having the support of the administration at the highest level is certainly a very strong statement.”

The second amendment of the United States Constitution

“A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed

The gun debate is interesting in that many people apply the literal wording of the second amendment to today.

The United States was a very different place when the second amendment was adopted in December 1791. Let’s discuss why the founding fathers included the “right to bear arms” clause, and made it number two on the list.

The second amendment was partially based on the right to keep and bear arms in English common-law, and influenced by the English Bill of Rights of 1689.

English judge Sir William Blackstone (1723-1780), legendary for writing the Commentaries on the Laws of England which profoundly influenced the founding fathers, described the right as an auxiliary right, supporting the natural rights of self-defense, resistance to oppression, and the civic duty to act in concert in defense of the state.

But equally important in understanding the mood of the moment, the English settlers of the thirteen colonies had just fought a very difficult war for independence from a government (and its military) which the settlers felt was oppressive.

In the event that the new United States government should follow the same path, the founding fathers allowed the people to bear arms so that they could overthrow the new U.S. government by defeating its army, just as the common people had risen to defeat the British army of King George III (once more, resistance to oppression).

“That” was the thought in their minds when they wrote the second amendment.

Fast forward to today, the amendment is perceived far differently, in a way unimaginable to the founding fathers some 225 years ago.

Other constitutional amendments have been revised since the Constitution was written, keeping them up to date, relevant with the times........but not the second amendment.

Hillary’s gun confiscation proposal is going to backfire in a big way

Hillary Clinton’s suggestion that the United States should look at a “buyback program” similar to Australia’s draconian laws which they instituted in 1996 following a mass shooting in Tasmania. As AP noted, this wasn’t a gun buy back program such as many states and municipalities have offered. It was mandatory confiscation with a modest cash reimbursement to soften the blow.

Before moving on to the latest news on this story, it’s worth noting (particularly for Hillary Clinton’s campaign office) that the immediate results of the Australian gun grab

Gun owners in Australia were forced by new law to surrender 640,381 personal firearms to be destroyed by their own government, a program costing Australia taxpayers more than $500 million dollars. The first year results:

  • Australia-wide, homicides went up 3.2 percent
  • Australia-wide, assaults went up 8.6 percent
  • Australia-wide, armed robberies went up 44 percent (yes, 44 percent)
  • In the state of Victoria alone, homicides with firearms are now up 300 percent. Note that while the law-abiding citizens turned them in, the criminals did not, and criminals still possess their guns.
  • Australian and U.K. “buybacks” were merely an attempt to mollify firearm owners whose property had been declared contraband and subject to seizure. They were, to paraphrase Vito Corleone, an offer gun owners could not refuse. The owners had the “choice” to accept the money and turn the guns they had previously been forced to register or they could risk the government forcibly confiscating the guns and being sent to prison for possessing them, supposing, of course, that they survived the confiscation attempt itself.
  • AP already noted, this is a winning strategy for Clinton in the primary because her voter base has been sold on the idea of things like expanded background checks at the federal level, a national gun registry and confiscation. Regarding a total ban on all semi-automatic weapons, including handguns and shotguns, as of last year there was a 83% approval for the proposed action among the Democratic and Independent voter base.
