Democrats in Illinois are in the process of stripping the "right to conscience" from a 20 year old law that basically says you don't have to have any medical procedure or take any drugs which violate your religion or goes against your better judgement...in other words, right now Illinois law says you can refuse any drug or medical procedure you don't think is right for you. Of course they can't have THAT standing in the way of their mandates! Ben Franklin said it best: "Democracy is two wolves and a lamb voting on what to eat for dinner. Liberty is a well-armed lamb contesting the vote." My rights aren't up for a vote. Anyone planning to assault my nose with one of their swabs will find their own nose assaulted with my fist. Anyone planning to perforate my skin with their needle will find their own skin perforated with my knife. If my wife is given an ultimatum (jab or she's fired) and she reluctantly takes the jab against her better judgement and ANY adverse effects come about, there will be some adverse effects for the store manager on up the chain pushing this crap. Anyone injects one of my kids with this crap and they're just going to be dead. Those in power trying to push these "vaccines" just don't realize how serious we who don't want/need them really are...and they'll either come to their senses and just stop pushing, or they'll learn the hard way. I'll get fired. I'm stubborn like that, and know I can get another job probably making more money with a shorter commute, and not spend more than a couple days unemployed. My wife's not as sure she could make what she's making now elsewhere...and that's what these folks profiting off the jab (with ZERO liability if it harms you) are counting on.

Fifth Circuit Court once again slams OSHA and the current banana republic attempt to circumvent the Constitution. Read it here:

And there are two facts you need to know: Congress created OSHA

to assure Americans 'safe and healthful working conditions and to preserve our human resources.' ... It was not — and likely could not be, under the Commerce Clause and nondelegation doctrine — intended to authorize a workplace safety administration in the deep recesses of the federal bureaucracy to make sweeping pronouncements on matters of public health affecting every member of society in the profoundest of ways. [p. 6, citations and footnote omitted.]

OSHA's authority regarding issuing an ETS is also extremely narrow, requiring a grave danger from exposure to hazardous substances, toxic agents, or new hazards, all of which require urgent intervention.  ETSes are "'an 'unusual response' to 'exceptional circumstances'" (p. 8, citations omitted).  The legal standard is that this "extraordinary power" must be "delicately exercised" and only in "limited situations" (ibid.).

To meet the legal requirements, OSHA would have had to act with incredible speed to issue a narrowly crafted mandate drilling into the places with the highest risk.  (Perhaps targeting the New York subways or American meatpacking plants in Spring 2020.)  Instead, notes the court, the mandate came almost two years into the virus's depredations and almost two long months after the president declared there was an emergency requiring a mandate.  Moreover:

[R]ather than a delicately handled scalpel, the Mandate is a one-size-fits-all sledgehammer that makes hardly any attempt to account for differences in workplaces (and workers) that have more than a little bearing on workers' varying degrees of susceptibility to the supposedly "grave danger" the Mandate purports to address. (p. 8)

In another gem of a paragraph, the Court describes the mandate as "fatally flawed on its own terms."  Thus:

[T]he Mandate's strained prescriptions combine to make it the rare government pronouncement that is both overinclusive (applying to employers and employees in virtually all industries and workplaces in America, with little attempt to account for the obvious differences between the risks facing, say, a security guard on a lonely night shift, and a meatpacker working shoulder to shoulder in a cramped warehouse) and underinclusive (purporting to save employees with 99 or more coworkers from a "grave danger" in the workplace, while making no attempt to shield employees with 98 or fewer coworkers from the very same threat). (p. 6)

And of course, there's chief of staff Klain's retweet, which the Court suggests is an admission that using OSHA was a deliberate attempt to circumvent "Presidential Candidate Bidumb's" constitutional inability to issue such a mandate.

The Court touches upon a few other things, including the fact that COVID's risks are very uneven, depending on a person's age, general health, and immunity, and OSHA's past statements about its lack of power to make mandates for infectious diseases.

The Court also notes a couple of serious constitutional problems.  While states have vast powers over public health, the Commerce Clause means that the federal government does not: "A person's choice to remain unvaccinated and forgo regular testing is noneconomic inactivity," and therefore within the states', not the federal government's, purview.  Likewise, Separation of Powers principles mean that an agency operating under the Executive cannot exceed the narrow mandate Congress gave it.

With regard to this last point, the Court gave a nod to the Supreme Court's decision earlier this year holding that the CDC may not make housing policy by issuing eviction moratoriums.  It noted that Congress can only give away so much of its authority, for "health agencies do not make housing policy, and occupational safety administrations do not make health policy" (p. 20).

So, my cousin's girlfriend tested positive for covid. She had all the classic symptoms..... a sore throat and a runny nose for two days. You know, kinda like a common cold.

 

She has to stay home two weeks then she can go back to work. No retest required.

Her daughter and anyone that was around her (that have no symptoms)......you must get tested, stay home a week and then you must get retested to return to work after that.

Does that make any sense??? I guess if you have covid it just disappears after 10 days, LOL

 

PS.....all are double vaccinated.

Non of this Kung Flu thing makes sense to me...  Yes many people got sick and died... That just sucks!!!!  Kung Flu added to thier existing health issues and killed them..   Yes, I am about to get my butt handed to me for saying that ....  oh well....  Im sorry that your kin got sick, it suck's,,  I got the Kung Flu 2/25/21.   I was sick for almost all of March, I had lingering effects from it as well...  for month's, Hell who know's,  mabey the new A-Hole that I am is caused by it.. My issue is that our NEW Commie gov't uses this as a power grab and a tool to control U.S. Citizens... My brother-in-law died in his sleep 3 month's ago, and a Hospital rep offered my sister-in-law, $9000.00 if she said it was a Kung Flu death..    Anyway, our experience here is one of a bunch of Commie B.S.   sorry for my rant,  but I'm pissed...

My buddies wife just passed away at 55. Had a heart attack and total heart failure. They had covid induced heart failure on the death certificate. When he said that wasn't right, they told him "it's OK, you get $9,000 for funeral expenses if it's caused by covid"  Turns out it also nullified her life insurance because a lot of policies don't pay out on deaths caused by a pandemic.
